The Federal Circuit and Family Court of Australia (FCFCOA) Report: A Positive Review of the 2021 Act Reforms

The Federal Circuit and Family Court of Australia (FCFCOA) has received the statutory review of the Federal Circuit and Family Court of Australia Act 2021 (Cth), presented by the Attorney-General, the Hon Michelle Rowland MP. Chief Justice Alstergren welcomed the overwhelmingly positive findings of the report, highlighting the Court’s innovations, case management processes, responsiveness, and effective delivery of justice.

The review praised several reforms as highly successful, particularly the single point of entry, which was described as an outstanding success and a “game-changer” in family law. This reform has led to greater clarity, efficiency, and cooperation across the system. The expanded role of registrars was also recognized for its significant contribution, helping streamline processes.

The Court’s focus on early risk assessment has greatly improved the handling of family violence and other risk factors, ensuring better case management and reducing system abuse.

Additionally, the review noted a strong sense of collegiality among judges, with dual leadership appointments promoting consistent leadership and unity. Changes to appellate jurisdiction were also highlighted as a major success, improving case management and timelines.

While there were some areas identified for further improvement, a Working Group has been formed to consider these ongoing refinements. The report commended the dedication and integrity of FCFCOA staff and the legal profession’s cooperation in achieving these positive results. The FCFCOA remains committed to serving Australians in family law, workplace rights, consumer rights, human rights, and bankruptcy disputes, and continuing to provide the best justice system.
