Important Legal Changes in Australia in 2025: What You Need to Know

Australia is introducing several significant new laws and amendments in 2025, which will affect various sectors including employment, migration, aged care, and more. These changes are designed to improve protections for workers, modernize migration processes, and address public health and safety concerns. Here’s a breakdown of some of the most important legal reforms coming into effect this year.

  1. Employment Law: Criminalization of Wage Theft: Intentional underpayment of wages and entitlements will now be classified as a criminal offense, with penalties including imprisonment and fines.
  2. Right to Disconnect: Employees will have the legal right to refuse unreasonable work-related contact outside of working hours. This new rule will apply to small businesses from August 26, 2025.
  3. Increased Protections for Workplace Delegates: New rights and protections will be introduced for workplace delegates to ensure better representation and safety.
  4. Labour Hire Pay Parity: Labour hire employees will now be entitled to the same pay as direct employees, ensuring equal pay for equal work.
  5. Expansion of IRC Jurisdiction: The Industrial Relations Commission (IRC) will now handle cases related to workplace bullying and sexual harassment, with the power to conciliate, arbitrate, issue orders, and award compensation.

Migration:

  • Starting July 2025, significant changes to skilled migration visas will include increased income thresholds and revised application fees, making the process more transparent and competitive.

Aged Care:

  • From November 1, 2025, a new, rights-based Aged Care Act will come into effect, prioritizing the rights and dignity of older Australians in the aged care system.

Merger Control:

  • In 2025, Australia will transition from a voluntary to a mandatory merger notification system, effective from January 1, 2026.

Tobacco Products:

  • A ban on the sale of menthol cigarettes and menthol accessories will take effect from July 1, 2025, in an effort to reduce smoking rates.

Engineered Stone Imports:

  • A ban on the importation of engineered stone products, including benchtops, panels, and slabs, will begin on January 1, 2025, to protect workers from health risks associated with silica dust exposure.

National Minimum Wage and Superannuation:

  • The National Minimum Wage will rise by 3.5%, reaching $24.95 per hour or $948 per week, starting July 1, 2025. Additionally, the superannuation guarantee rate will increase from 11.5% to 12%.

Privacy and Defamation Laws:

  • Amendments to privacy laws may lead to stricter scrutiny of privacy policies and how personal information is handled. Courts may also award damages for emotional distress or punitive damages in defamation cases.
